Terms of Service

1. Contracting Entity

These Terms of Service govern access to and use of ComplySafe.io (the “Service”). The Service is operated by BitFoundry OÜ, an Estonian private limited company registered in Estonia (registry code: 17352996) with its registered office in Estonia.

By accessing or using the Service, you agree to be legally bound by these Terms. If you do not agree, you must not use the Service.

2. Description of Service

ComplySafe.io provides automated compliance scanning of websites, source code repositories, commits, and pull requests. The Service analyzes submitted or authorized content to detect potential privacy, security, and regulatory compliance risks.

The Service provides automated technical analysis only. It does not constitute legal advice, and no attorney client relationship is created.

3. Eligibility and Accounts

You must be at least 18 years old and legally capable of entering into binding agreements to use the Service.

• Provide accurate and current information
• Maintain confidentiality of login credentials
• Accept responsibility for all activity under your account
• Notify us promptly of unauthorized access

4. Acceptable Use

You agree to use the Service only for lawful purposes.

• Scan only assets you own or are authorized to analyze
• Do not attempt to bypass plan limits or safeguards
• Do not reverse engineer or interfere with the Service
• Do not use the Service for unlawful or abusive activity

We may suspend or restrict access for violations of these Terms.

5. Subscriptions, Trials, and Billing

Paid plans are billed in advance on a recurring basis unless cancelled. A valid payment method may be required to activate a trial.

Payments are processed by Stripe. By subscribing, you authorize recurring billing until cancellation.

Fees are non refundable except where required by applicable law.

Plans described as unlimited remain subject to fair and reasonable usage aligned with standard development workflows.

6. Intellectual Property

6.1 Our Rights

The Service, including software, branding, and detection logic, remains the exclusive property of BitFoundry OÜ and is protected by intellectual property laws.

6.2 Your Content

You retain ownership of content submitted or authorized for scanning. You grant us a limited, non exclusive license to process that content solely to provide the Service.

Customer repositories, code, and reports are not used to train shared artificial intelligence systems.

7. Availability and Disclaimer

The Service is provided on an as available basis. We do not guarantee uninterrupted operation or error free results.

Automated scan results may contain inaccuracies. You are solely responsible for reviewing outputs and obtaining professional advice where necessary.

8. Limitation of Liability

To the maximum extent permitted by law, BitFoundry OÜ shall not be liable for indirect, incidental, special, consequential, or punitive damages, including loss of revenue, data, or business opportunities.

Our total aggregate liability arising out of or relating to the Service shall not exceed the amount paid by you in the twelve months preceding the claim.

9. Indemnification

You agree to indemnify and hold harmless BitFoundry OÜ from claims, damages, and expenses arising from your misuse of the Service, violation of these Terms, or infringement of third party rights.

10. Termination

You may cancel your subscription at any time. We may suspend or terminate access for violations, non payment, abuse, or legal requirements.

Upon termination, access to the Service may be disabled and data may be deleted in accordance with our Privacy Policy.

11. Export Compliance

You agree not to use the Service in violation of applicable export control or sanctions laws.

12. Sanctions and Restricted Jurisdictions

The Service may not be accessed or used by any individual or entity that is subject to economic or trade sanctions administered or enforced by the European Union, Estonia, the United Nations, or other applicable authorities.

Without limitation, the Service is not available to users located in, organized under the laws of, or ordinarily resident in jurisdictions subject to comprehensive sanctions or financial restrictions. These may include, for example, Russia, Belarus, Iran, North Korea, Syria, and other jurisdictions designated under applicable sanctions regimes.

You represent and warrant that:

• You are not located in, incorporated in, or ordinarily resident in a sanctioned jurisdiction.
• You are not listed on any EU, UN, or other applicable sanctions list.
• You will not permit access to the Service in violation of applicable sanctions or export control laws.

We reserve the right to suspend or terminate accounts, block access, or refuse service where we reasonably determine that use of the Service may violate applicable sanctions, export control, or financial regulations.

13. Governing Law and Jurisdiction

These Terms are governed by the laws of Estonia. Any dispute arising out of or relating to these Terms shall be subject to the exclusive jurisdiction of the courts of Estonia.

14. Changes to Terms

We may update these Terms periodically. Continued use of the Service after updates become effective constitutes acceptance of the revised Terms.
